1. Acceptance of Terms
By accessing or using qr-dnr.com (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.
2. Description of Service & File Types
The Service enables users to generate QR codes containing user-submitted data for personal or emergency reference purposes. The Service offers two operational modes:
- Offline Temporary Files (Unregistered Users): Unregistered submissions generate a temporary file storing limited data directly inside the QR code for offline scanning. These files are accessible via a hashed, unlisted public URL. Temporary files are scheduled for deletion within 3 hours, subject to an extended window of up to 72 hoursin the event of unexpected technical maintenance or system errors.
- Public Online Profiles (Account Holders): Registered users may choose to create an online profile. This feature generates a permanent, publicly accessible web page displaying the user's full submitted data (including secondary contacts and extended emergency details). This page is accessed via an unlisted URL containing a unique, hard-to-guess secret hash. This online page is designed to provide complete details to emergency responders when internet access is available.
3. Public URL Mechanics & Privacy Acknowledgement
- Public Accessibility: You acknowledge and agree that while Online Profile URLs utilize complex, secret hashes to prevent guessing or automated indexing, these URLs are public and do not require authentication to view. Anyone in possession of your printed QR code, the direct URL, or the secret hash will be able to view all personal and medical information contained on that page.
- Consent to Disclose: Pursuant to the Personal Information Protection Act (PIPA) of British Columbia and applicable Canadian privacy legislation, by enabling an Online Profile, you explicitly authorize and consent to the public hosting and display of the personal data you submit for the purpose of emergency responder access.
- User Assumption of Risk: You assume all responsibility and risk for publishing personal information online via an unlisted URL. The Service is not responsible for unauthorized third-party scanning, sharing, or scraping of your QR code or public URL once generated.
4. Emergency Medical Disclaimer & No Reliance
- Not a Substitute for Formal Directives: The Service is a data-formatting tool. It does not constitute legal or medical advice, nor does it replace formal legal documentation or recognized medical orders required by health authorities.
- No Guarantee of First Responder Recognition or Action: You explicitly acknowledge, understand, and agree that there is no guarantee that paramedics, emergency medical technicians (EMTs), physicians, or other first responders will:
- Know what the card or QR code is, recognize its intent, or understand its presence.
- Possess, carry, or have access to a device, camera, QR scanner, or active internet connection capable of reading the card or loading an Online Profile.
- Attempt to read, scan, or inspect the card, QR code, or personal belongings during an emergency.
- Honor, comply with, or respect any Do Not Resuscitate (DNR) requests, medical preferences, or wishes expressed within the QR code or Online Profile. First responders are governed by emergency treatment protocols, local legal standards, and professional duties that may mandate immediate resuscitation regardless of information displayed via the Service.
- No Guarantee of Connectivity: Access to Online Profiles requires active mobile or internet connectivity; the Service is not liable if an Online Profile cannot be reached due to lack of network coverage, server downtime, or device incompatibility.
5. User Conduct & Acceptable Use
You agree not to submit any information that:
- Is false, misleading, or fraudulently impersonates another individual.
- Infringes on the intellectual property or privacy rights of third parties.
- Contains malicious code, viruses, or harmful software.
- Violates any applicable federal, provincial, or local law in Canada.
6. Account Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access to your account.
7. Service Availability & Limitation of Liability
- "As-Is" Provision: The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular emergency or medical purpose.
- Deletion Window: While we make every reasonable effort to delete temporary public files within 3 hours, we do not guarantee uninterrupted execution and are not liable for temporary delays up to 72 hours caused by system outages or repair requirements.
- Limitation of Liability: To the maximum extent permitted by the laws of the Province of British Columbia and the federal laws of Canada, qr-dnr.com and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- Public access to, or third-party misuse of, temporary or permanent hashed links.
- Loss, corruption, or deletion of data.
- The failure, refusal, or inability of any emergency responder or medical personnel to recognize, access, read, scan, or act upon information stored in a QR code or Online Profile.
- Medical outcomes, life-saving measures performed, or non-compliance with expressed wishes.
- Network outages or server downtime preventing access to Online Profiles.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the use of the Service shall be submitted to and resolved exclusively by the courts of competent jurisdiction located in Victoria, British Columbia, Canada. You irrevocably consent to the exclusive venue and jurisdiction of such courts.
